User Agreement

IMPORTANT -- Before purchasing from PipingOffice, please read this End-User Agreement.

Payment of the product fee indicates that you accept the following terms:

This is a legal agreement between you, the end user, and Ben A. Nottingham (owner of PipingOffice.com). Per this agreement, Ben A. Nottingham licenses the piping calculator spreadsheets and data files (the "CALCULATORS"), in whole or in part, for use only by the terms set forth herein. By copying, downloading, accessing or otherwise using any of these CALCULATORS, you agree to be bound by the terms of this agreement.

Purchasers who determine they should not have agreed to this EULA will be eligible to receive full refund less handling and shipping by informing Ben A. Nottingham within 15 days after purchase, and the media must be destroyed.

Purchasers are otherwise allowed a period of 30 days for evaluation of the product, and if not satisfied, the amount of money paid less handling and shipping costs will be refunded, and the media must be destroyed.

Seller's records including copies of checks and payment records will confirm proof of purchase.

1. GRANT OF USAGE:
   This EULA grants you the right to use the CALCULATORS as stated on your proof of purchase.
   
   User Licenses:
   

   Single User License: For use only by 1 person.

   Multiuser License: If there are 3 or more users, including with access on a network and/or intranet, then the price would be 3 times single user price. Just enter 3 at checkout and get 1 download link in email.

   For security, the individual or IT department should prepare a new folder which will contain extracted files. This folder would be copied to single users or made network accessible to all assigned multiusers, as applicable.

   Security settings for the folder will likely show as blocked initally, which is good for testing on a standalone computer. (Search for Microsoft's various instructions for blocking or unblocking a folder or single file.).

   Free updates will be allowed during the 12 months following a purchase, and the buyer must request them if not sent by PipingOffice.

2. PROPREITARY PARTS:
   You should not remove or alter any rights statement, disclaimers, terms of use, or other proprietary notices within the CALCULATORS. Do not sell or give away any of the CALCULATORS without the approval of Ben A. Nottingham.
   
   
3. WARRANTY:
   The spreadsheet files do not contain password protections, thus the formulas and macros can easily be overwritten. Because software is inherently complex and may not be completely free of errors, you are advised to verify your work and to make backup copies.
   
   
4. RIGHTS:
   Ben A. Nottingham wants to own all intellectual property rights but there are no trade secrets or confidential information in the CALCULATORS and user documentation. Technologies used are publicly available. Notwithstanding the foregoing, you may cut, paste or insert PipingOffice data, calculation results or tables from the CALCULATORS for use solely in professionally or otherwise prepared engineering calculations, internal documents and presentations.
   
   
5. PURCHASE OUTSIDE THE UNITED STATES:
   If you purchased this product for use outside the United States of America, you agree to the following: The parties are aware that the product and this Agreement, as well as all other documents relating hereto, including Notices, have been and shall be drawn up in the English language only. Exporting from United States designation is EAR99, No License Required.
   
   
6. GENERAL:
   This Agreement will be governed by the laws of the State of Tennessee, United States of America, except for that body of law dealing with conflicts of law. Should you have any questions concerning this Agreement or if you desire to contact Ben A. Nottingham for any reason, please click on the link below to send electronic mail.
   
   
7. TERMINATION:
   Without prejudice to any other rights, PipingOffice.com may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of any CALCULATOR suite.
   
   
8. NOTICE SPECIFIC TO CALCULATORS:
   PIPINGOFFICE.COM MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE CALCULATORS FOR ANY PURPOSE. ALL CALCULATORS ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. PIPINGOFFICE.COM HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE CALCULATORS, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT SHALL PIPINGOFFICE.COM BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE CALCULATORS OR USER DOCUMENTATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL PIPINGOFFICE'S LIABILITY EXCEED THE AMOUNT PAID FOR THE CALCULATORS.
